Effective: 2026 Season | Version 2.1
Please review these terms before registering a child in any Footie Elite program. By completing registration, the parent or legal guardian confirms that they have read, understood, and agree to these terms on behalf of themselves and the Participant.
By registering a child (“Participant”) in any Footie Elite program, the parent or legal guardian (“Guardian”) acknowledges and agrees that participation in soccer and related physical activities involves inherent risks of physical injury, including but not limited to bruises, sprains, fractures, or other harm resulting from falls, collisions, physical exertion, and contact with equipment or other participants.
The Guardian voluntarily assumes all such inherent risks on behalf of the Participant and confirms that the Participant is in adequate physical health to participate in the program. Footie Elite shall not be held liable for injuries arising from these inherent risks, provided that reasonable precautions and safety standards have been maintained.
To the fullest extent permitted by applicable law, including the Consumer Protection Act (CQLR, c. P-40.1) and the Civil Code of Quebec, the Guardian, on behalf of themselves and the Participant, hereby releases, waives, discharges, and holds harmless Footie Elite Inc., its co-founders (Julian Hughes, Eric Guerguinov, Nico Guerguinov), employees, coaches, contractors, volunteers, agents, and representatives (collectively, the “Releasees”) from any and all liability, claims, demands, damages, costs, or causes of action arising out of or relating to the Participant’s participation in any Footie Elite program.
This waiver applies to claims arising from ordinary negligence. It does not apply to gross negligence or intentional misconduct. In Quebec, certain consumer rights cannot be waived by contract and are not affected by this clause.
In the event of injury, illness, or medical emergency during a Footie Elite program, and if the Guardian cannot be reached in a timely manner, the Guardian hereby authorizes Footie Elite staff to: (a) administer reasonable first aid; (b) call emergency medical services; and (c) consent to emergency medical treatment on behalf of the Participant as deemed necessary by medical professionals.
All costs associated with emergency medical treatment remain the sole responsibility of the Guardian. Footie Elite shall not be held liable for any medical decisions made in good faith under emergency circumstances.
The Guardian is solely responsible for disclosing all relevant medical conditions, allergies, physical limitations, and emergency contact information at the time of registration. Footie Elite relies entirely on the information provided by the Guardian and cannot be held responsible for adverse outcomes arising from information that was not disclosed or was inaccurately reported.
It is the Guardian’s responsibility to notify Footie Elite immediately if any relevant health information changes during the program season. Notifications must be sent in writing to info@footie-elite.com.
All Participants are expected to behave respectfully toward coaches, peers, and other program participants at all times. The following behaviours are grounds for immediate removal from the program without refund:
Footie Elite is committed to maintaining a safe, positive, and respectful environment for all children and coaches. Guardians are expected to interact with Footie Elite staff in a respectful and constructive manner at all times. Behaviour that is abusive, threatening, or disruptive — whether on-site, by phone, or in written communications — will not be tolerated.
Footie Elite reserves the right to remove a family from the program immediately, with no refund, if a Guardian engages in conduct that poses a risk to the safety, wellbeing, or professional environment of the program. This determination is made at the sole and absolute discretion of Footie Elite management, and shall apply only in cases of conduct that is objectively unreasonable, threatening, or harmful.
Footie Elite is committed to delivering all scheduled outdoor sessions as planned. Coaches attend all scheduled sessions regardless of mild weather conditions. Session cancellations are the exception, not the rule.
The coach present on-site holds final authority over whether a session proceeds, is modified, or is cancelled due to weather conditions. This decision is made at the start of or during the session based on real-time field and weather assessment.
In the event of lightning or thunder, all outdoor sessions are immediately suspended. Sessions may resume only after 30 consecutive minutes have passed without lightning or thunder, in accordance with Quebec outdoor safety standards. If lightning persists and the session cannot safely resume, the session will be cancelled.
In cases of extreme weather events, natural disasters, or other circumstances entirely beyond human control (“Acts of God”) that prevent a session from taking place, Footie Elite will make reasonable efforts to offer a makeup session, but no refund will be issued for sessions lost due to such events.
In the event of a cancellation, Footie Elite will notify affected families as promptly as possible via SMS and/or email to the contact information provided at registration.
Footie Elite reserves the right to cancel, reschedule, or merge any session, group, or program if minimum enrollment thresholds are not met, or due to circumstances beyond Footie Elite’s reasonable control. In such cases, Footie Elite will first offer affected families a transfer to an equivalent available group or session. If no suitable alternative is available, a full refund of all amounts paid — including the Registration Fee — will be issued within 15 business days.
This right to cancel applies only to program-level cancellations initiated by Footie Elite and does not apply to withdrawals initiated by the Guardian.
Upon completing registration, a registration fee of $25.00 CAD (“Registration Fee”) is charged to cover payment processing costs, account setup, and program administration expenses incurred by Footie Elite at the time of registration. The Registration Fee is non-refundable and non-transferable under all circumstances, including but not limited to cancellation, voluntary withdrawal, missed sessions, or program transfers, unless the program is cancelled by Footie Elite pursuant to Section 7.
In the event of a voluntary withdrawal or cancellation by the Guardian after registration, a cancellation fee (“Cancellation Fee”) will be charged. In accordance with the Consumer Protection Act (CQLR, c. P-40.1), the Cancellation Fee shall be equal to 10% of the total value of remaining, undelivered sessions at the time the written cancellation request is received by Footie Elite. The Cancellation Fee shall not exceed $50.00 under any circumstances.
Cancellation Fee = 10% × (number of remaining sessions × per-session value). Example — Full program (10 sessions at $37.50/session = $375.00 total):
If a written cancellation request is received at info@footie-elite.com before the first session of the enrolled season has taken place, the following amounts will be retained by Footie Elite and are non-refundable:
The remaining balance will be refunded to the original payment method within 15 business days of receiving the written cancellation request.
If a written cancellation request is received at info@footie-elite.com after the season has commenced, the refund will be calculated as follows:
Refund = Remaining session value − $25.00 Registration Fee − Cancellation Fee (10% of remaining session value).
No refund will be issued for sessions already delivered or elapsed at the time the cancellation request is received. The refund will be issued to the original payment method within 15 business days.
A minimum of three (3) sessions must have been delivered to the Participant before a mid-season refund request under Section 8.4 will be accepted. This threshold exists to ensure that the program has been meaningfully experienced before a withdrawal is requested. Cancellation requests submitted before this threshold is met will not be processed and will be treated as a pre-season cancellation under Section 8.3.
No refund, credit, or makeup session will be issued for sessions missed due to the Participant’s own absence, including but not limited to illness, scheduling conflicts, loss of interest, or any other personal reason not attributable to Footie Elite.
The trial session fee of $5.00 is strictly non-refundable, regardless of whether the Participant attends the trial session. This fee confirms registration intent and ensures that no unregistered individual attends a session.
Payment processing fees charged at the time of registration (e.g., credit card or platform fees) are non-refundable and will not be included in any refund calculation.
Footie Elite offers one (1) makeup session per training season for unattended sessions, subject to the following conditions:
Makeup sessions do not carry over to future seasons. No refund is issued in lieu of a makeup session. Makeup session availability is subject to capacity and scheduling constraints.
All camp registrations require a non-refundable deposit of $100.00 per week booked, payable at the time of registration. This deposit reserves the Participant’s spot and is retained by Footie Elite under all circumstances, including cancellation by the Guardian.
If a written cancellation request is submitted to info@footie-elite.com before the camp start date, the remaining balance (total fees paid minus the $100.00/week non-refundable deposit) will be refunded within 15 business days.
No refund will be issued for any cancellation made on or after the first day of camp. This applies regardless of the reason for cancellation.
In cases of documented illness or injury preventing the Participant from attending camp, Footie Elite may, at its sole discretion and upon receipt of supporting medical documentation, offer a credit toward a future camp season. This credit is not transferable to other participants and does not apply to the $100.00/week non-refundable deposit.
All merchandise purchases, including but not limited to jerseys, training kits, bags, and accessories, are final sale. No refunds will be issued for merchandise under any circumstances. Size exchanges may be accommodated within 14 days of purchase, subject to availability, provided the item is returned in its original, unworn condition with all tags attached.
By registering in a Footie Elite program, the Guardian grants Footie Elite permission to capture photographs and video recordings of the Participant during sessions, events, and related activities for use in Footie Elite’s marketing materials, social media platforms, website, and promotional content. No compensation will be provided for such use.
If the Guardian does not consent to the Participant’s image being used, they must notify Footie Elite in writing at info@footie-elite.com prior to the first session. Footie Elite will make reasonable efforts to exclude the Participant from published materials; however, incidental appearances in group footage cannot be guaranteed to be fully excluded.
Footie Elite collects and retains personal information (including names, contact details, and medical information) solely for the purposes of program administration, communication, and safety. All personal data is handled in accordance with Quebec’s Act respecting the protection of personal information in the private sector (Law 25 / Bill 64).
Footie Elite does not sell or share personal information with third parties for commercial purposes. Guardians may request access to or deletion of their personal information at any time by contacting info@footie-elite.com.
Footie Elite reserves the right to assign, reassign, or substitute coaches at any time and without prior notice to the Guardian. A change in assigned coach does not constitute grounds for a refund, credit, or cancellation. Footie Elite maintains consistent coaching standards across all its coaches to ensure program continuity.
For the safety and wellbeing of all Participants and coaches, Footie Elite requests that any child showing symptoms of contagious illness (including fever, vomiting, or respiratory illness) be kept home from sessions until fully recovered. Footie Elite reserves the right to ask a visibly unwell Participant to be removed from a session.
No refund or credit will be issued for sessions missed due to illness, except as provided under Section 9.4 for camp registrations.
For all outdoor and indoor sessions, a parent or guardian is required to remain on-site for the entire duration of the session. Participants may not be left unattended at the field, gym, or facility.
Parents or guardians must be immediately available if needed during the session.
Footie Elite accepts no responsibility for the safety or supervision of Participants outside of scheduled session time, including before the session begins and after the session ends.
Soccer coaching may involve incidental physical contact as part of normal, safe instruction. Examples include: adjusting a Participant’s body stance or foot position; repositioning arms, hips, or shoulders to demonstrate technique; guiding a movement or skill; helping a fallen Participant to their feet; and age-appropriate celebratory contact such as high-fives or fist bumps. All such contact is intended solely for instructional, safety, or motivational purposes and is conducted openly, in full view of other participants or guardians.
Footie Elite coaches are required to adhere to the following standards at all times:
Footie Elite takes the safety and wellbeing of every Participant with the utmost seriousness. If a Guardian has a concern about any physical interaction between a coach and their child, they are encouraged to raise that concern immediately by contacting Footie Elite management at info@footie-elite.com or by calling 438-924-2350. All concerns will be investigated promptly and in good faith.
Guardians acknowledge that incidental or instructional physical contact as described in Section 16.1, conducted within the standards set out in Section 16.2, does not constitute grounds for a refund, credit, or legal claim against Footie Elite, its staff, or its agents.
Transfers between session times, days, or locations within the same season may be accommodated subject to availability and management approval. All transfer requests must be submitted in writing to info@footie-elite.com. Transfers between indoor and outdoor programs, or across seasons, are not guaranteed. An administrative fee may apply.
Footie Elite reserves the right to amend, update, or modify these Terms and Conditions at any time. Material changes will be communicated to registered families via email prior to taking effect. Continued participation in a Footie Elite program following notice of a change constitutes acceptance of the updated terms.
These Terms and Conditions are governed by and construed in accordance with the laws of the Province of Quebec and the applicable laws of Canada, including the Consumer Protection Act (CQLR, c. P-40.1) and the Civil Code of Quebec. Any dispute arising under these terms shall be subject to the exclusive jurisdiction of the courts of the Province of Quebec.
Conformément à la Charte de la langue française du Québec, Footie Elite offre une version française de ces conditions sur demande. En l’absence d’une demande expresse de la version française, les parties consentent à ce que ce document soit rédigé en anglais. / In accordance with the Charter of the French Language, a French version of these Terms is available upon request. In the absence of such a request, the parties agree that this document may be in English.
If any provision of these Terms and Conditions is found to be invalid, unenforceable, or in conflict with applicable law by a court of competent jurisdiction, that provision shall be severed and the remaining provisions shall continue in full force and effect.

The Guardian further confirms that they are the legal parent or guardian of the Participant, that all information provided at registration is accurate and complete, and that they have the legal authority to enter into this agreement on behalf of the Participant.
