Terms and Conditions / Waiver of Liability

Soccer involves inherent risk of injury, including falls, collisions, sprains, fractures, and similar harm. The Guardian accepts these risks on behalf of the Participant and confirms the Participant is fit to take part. Footie Elite USA is not liable for injuries from these ordinary risks where reasonable safety precautions were followed.

To the fullest extent allowed by Maryland law, the Guardian, on behalf of themselves and the Participant, releases Footie Elite USA, its owners, coaches, employees, contractors, volunteers, and agents from claims arising from ordinary negligence during a Footie Elite USA program. This release does not cover gross negligence, reckless or intentional misconduct, or rights that cannot legally be waived.

To the fullest extent allowed by Maryland law, the Guardian also agrees to defend and indemnify Footie Elite USA against a claim brought on the Participant's behalf arising from an ordinary program risk or ordinary negligence, except where the injury was caused by gross negligence, reckless or intentional misconduct, or another claim that cannot legally be waived or indemnified.

If the Guardian cannot be reached during an emergency, Footie Elite USA staff may administer first aid, call 911, and seek necessary emergency treatment. The Guardian is responsible for any resulting medical costs not covered by insurance.

The Guardian must disclose relevant medical conditions, allergies, and limitations at registration and update Footie Elite USA in writing at footie.elitedmv@gmail.com if anything changes. Footie Elite USA is not responsible for outcomes tied to information that was not disclosed.

Participants and Guardians must treat coaches, staff, and other families with respect. Footie Elite USA may remove a Participant or family from the program without refund for physical aggression, harassment, discrimination, or abusive or threatening behavior toward staff or others, where permitted by law.

Outdoor sessions run as scheduled in mild weather; the on-site coach has final authority to modify, suspend, or cancel a session. All outdoor activity stops immediately at any sign of lightning or thunder and resumes only after 30 clear minutes. Families are notified of cancellations by SMS or email. No refunds are given for sessions lost to weather or other events outside Footie Elite USA's reasonable control, though a makeup session will be offered where possible.

All prices are in U.S. dollars. A trial session is included with a $5 online processing fee that reserves the Participant's spot. The processing fee and any other payment-processing fees are non-refundable. Trials are limited to one reservation per family email and remain subject to capacity.

If a Guardian cancels a season registration before the season starts, the refund equals the amount paid less 10% of the full program value. For a mid-season cancellation, the refund equals the value of remaining, undelivered sessions less 10% of that remaining value. The cancellation fee is capped at $50, no refund is issued for sessions already delivered, and at least three sessions must have been delivered before a mid-season refund will be considered.

No refunds are issued for sessions missed because of the Participant's absence, including illness or scheduling conflicts. One makeup session per season may be available with 48 hours' written notice, subject to capacity and scheduling availability.

Cancellation requests must be submitted in writing to footie.elitedmv@gmail.com. Approved refunds are issued to the original payment method within 15 business days. This policy does not limit rights required by law.

Summer or school-break camp registration requires a non-refundable deposit of $100 per week booked. Cancelling before camp starts refunds the balance beyond that deposit; cancelling on or after the first day of camp is non-refundable. With documented illness or injury, Footie Elite USA may, at its discretion, offer a credit toward a future camp. The deposit remains non-refundable.

All merchandise sales are final. Size exchanges may be accommodated within 14 days if items are unworn with tags attached, subject to availability.

Footie Elite USA may photograph or film Participants during sessions and events for use in marketing and social media, with no compensation owed. Guardians who do not consent must notifyfootie.elitedmv@gmail.com in writing before the first session. Incidental appearances in group footage cannot always be fully avoided.

Personal information collected at registration is handled as described in the Footie Elite USA DMV Privacy Policy. Footie Elite USA may substitute coaches when operationally necessary. A parent or Guardian must remain on-site for the full duration of every session. Footie Elite USA is not responsible for supervision outside scheduled session time.

Coaching involves only normal, visible instructional contact, such as adjusting stance, guiding a movement, helping a fallen child up, or high-fives. Coaches must never be alone with a Participant in a private or non-visible space. Report a concern immediately to footie.elitedmv@gmail.com or 917-912-6240 so it can be investigated promptly.

Footie Elite USA may amend these Terms with notice by email; continued participation after notice means acceptance. Program transfers between times, days, or locations require a written request and are subject to availability.

This Agreement is governed by Maryland law, and any dispute must be handled in the state or federal courts serving Montgomery County, Maryland. If any part of this Agreement is found unenforceable, the remaining provisions stay in effect.

By registering and checking the acknowledgment box, the Guardian confirms they are the Participant's legal parent or guardian, all registration information is accurate, and they have read and agree to this Agreement, including the release and indemnification terms in Section 2 and the fee terms in Section 7.
